Because that's what WinPcap requires in order to load its driver:

You should ask the WinPcap developers about this.
When I installed 0.10.12 with the beta Winpcap, during the Winpcap installation one of the options was to install a service that (according to the information displayed) allows captures to be done without privilege. I have not tried it, and a quick look at the Winpcap site did not turn up any documentation about this, but you might look into it.
