Hmmm, shouldn't happen, and I don't think this depends on the platform
you use, but who knows...

I've implemented this assert to be sure that the internal logic of the
capturing engine is working correct. So there still seems to be a
logical problem somewhere in the program or the understanding I have of
it :-(

What are the *exact* steps you use to reproduce this?
Does it happen right after you starting Ethereal or the second time you
start a capture or ...
